Dubai property law, the fees and limits it actually sets

Every fee, cap and notice period this site quotes is set by a resolution, a decree or a law, and each one is public, free and better written than the brokerage page that paraphrases it. This is the register of those instruments: what each one sets, in its own words, and the page on this site that does the arithmetic with it.

Buying and selling

2013

Executive Council Resolution No. (30) of 2013 Approving Fees of the Land Department, Article 3 and Schedule

Sets every fee the Land Department charges to register a sale, a mortgage or a title, and says who is liable for the sale fee when the contract is silent.

In the instrument's own words, it sets:

  • 4% of the value of the sale contract
  • shared equally by the seller and purchaser
  • 0.25% of the mortgage (debt) value

Land Department service page

Dubai Land Department, Property Sale Registration, service fees

The Land Department's own service page for registering a sale, which is where the trustee office fee, the title deed fee and the map fee are published.

In the instrument's own words, it sets:

  • 2% of the sale value
  • AED 4,000 + VAT If the sale value is AED 500,000 or more
  • AED 2,000 + VAT If the sale value is less than AED 500,000
  • AED 250 Title Deed Certificate Issuance Fee

2017

Federal Decree-Law No. (8) of 2017 on Value Added Tax, Article 3

Federal law setting the standard rate of value added tax, which applies to agency commission and to the trustee's fee but not to the Land Department's own registration fee.

In the instrument's own words, it sets:

  • standard rate of the tax to be levied on any supply or importation shall be (5%)

Renting

2013

Decree No. (43) of 2013, Articles 1 and 3

Sets the maximum rent increase a landlord may impose on renewal, in bands measured against the official rent index.

In the instrument's own words, it sets:

  • no increase at all up to a maximum of twenty percent
  • the Rent Index of the Emirate of Dubai approved by the Real Estate Regulatory Agency

2008

Law No. (33) of 2008 amending Law No. (26) of 2007, Articles 14 and 25

The tenancy law, with the notice a landlord must give to change a term on renewal and the notice and method required to evict for sale or own use.

In the instrument's own words, it sets:

  • no less than ninety days before the date on which the lease contract expires
  • at least twelve months before the date of eviction
  • served through a Notary Public or by registered mail

Holiday homes

2014

Executive Council Resolution No. (49) of 2014, Schedules 1 and 2

Sets the holiday home permit fee, the inspection fee and the fines for operating without a licence, for charging guests for utilities and for letting less than a whole unit.

In the instrument's own words, it sets:

  • AED 300 per bedroom
  • capped at AED 1,200 a year
  • AED 300 per unit
  • AED 2,000 fine for charging a guest for electricity or water
  • AED 5,000 fine for operating without a licence
  • AED 500 fine for letting rooms or beds rather than the whole unit
